Service Terms and Conditions
(U.S. Retail Repairs – Massachusetts)
These Terms and Conditions (“T&Cs”) govern the service of your product by Davis Tech Repair (“DTR”).
1. Service Authorization and Charges
DTR will service your product as described and for the charges shown on the invoice, plus any applicable taxes. When service is covered by DTR’s 30-day warranty for parts and labor, those terms will apply. Repairs for other issues, or damage arising during or after service, are not covered under this warranty.
2. Parts and Repairs
DTR uses aftermarket, refurbished, and OEM parts for repairs, depending on availability. Customers are informed about the type of parts used prior to service.
If a repair is required due to prior unauthorized modifications, misuse, or external damage, DTR reserves the right to return the product without servicing it and may charge a diagnostic fee.
3. Data Responsibility
Customers are advised to back up all existing data before submitting a device for service. DTR is not responsible for any data loss, recovery, compromise, or loss of use arising from services provided.
If requested, DTR may offer data transfer services between devices, subject to the limitations of available technology and customer consent. However, DTR cannot guarantee complete data transfer or recovery.
4. Warranty
DTR warrants for 30 days from the date of service that (1) repairs will be performed competently and (2) parts used will be free from defects in materials and workmanship.
If a defect arises during this warranty period, DTR will, at its discretion:
- Re-perform the repair;
- Replace the defective part
This warranty does not cover new or unrelated issues that occur during or after the repair.
5. Liability Limitations
To the maximum extent permitted by law, DTR is not liable for indirect, incidental, or consequential damages, including data loss, lost profits, or loss of device functionality. If your product is damaged or lost while in DTR’s custody, liability is limited to the cost of repair or replacement of the product.
6. Unclaimed Products
Products unclaimed within 60 days of repair completion notification will be considered abandoned and may be disposed of per Massachusetts law.
7. Service Process and Responsibility
Customers are responsible for:
- Providing an accurate description of the issue.
- Removing security locks, passwords, or encryption on devices prior to service.
- Ensuring devices submitted for service are free from illegal content or software.
Failure to follow these guidelines may result in delays or inability to complete service.
8. Payment and Refunds
Payment is required before service begins unless otherwise agreed. Refunds will not be issued for diagnostic fees or completed repairs unless covered by the 30-day warranty.
9. Privacy and Data Protection
DTR collects and processes customer information only to perform services under these T&Cs. Customer data will be handled in accordance with privacy standards and will not be shared without consent.
10. Governing Law
These T&Cs are governed by the laws of the Commonwealth of Massachusetts.
