(MA – U.S. Retail Services)

These terms apply specifically to data recovery services provided by Davis Tech Repair (“DTR”) and are in addition to DTR’s general Service Terms and Conditions.

Governing Law
These terms are governed by the laws of the Commonwealth of Massachusetts.

Risk of Data Loss
Data recovery services carry inherent risks, including potential partial or complete loss of existing data. DTR is not responsible for any data that is unrecoverable, lost, overwritten, or damaged during the recovery process. Customers are advised to maintain their own backups prior to submitting devices for recovery.

Scope of Service and Limitations
Data recovery is attempted using specialized tools and techniques, but success is not guaranteed. Recovery depends on the condition of the media, severity of damage, and availability of donor parts or software compatibility.
DTR does not guarantee recovery of specific files, folder structures, or program settings. The service covers recovery of user data only and does not include reinstallation of software or operating systems unless otherwise agreed.

Diagnostic and Recovery Fees
Diagnostic fees for data recovery are non-refundable and due before work begins. If recovery is successful, an additional fee based on the complexity and volume of recovered data will be charged. The customer will be provided with an estimate prior to proceeding.

Storage Media
Recovered data will be transferred to an external drive provided by the customer or purchased from DTR at an additional charge. The recovered data will not include applications or system files unless specifically requested and possible. DTR does not guarantee the completeness or integrity of recovered files.

Limit of Liability
DTR is not liable for any indirect, incidental, or consequential damages, including but not limited to data loss, software corruption, lost profits, or downtime.
In all cases, the total liability of DTR is strictly limited to the amount paid by the customer for the data recovery service.

No Return of Original Media or Parts
Storage devices, including failed hard drives, USBs, or SD cards, may not be returned if they are opened, damaged beyond safe use, or disposed of as part of the recovery process. If return of original hardware is required, it must be requested in advance and may incur additional handling fees.

Abandoned Devices and Recovered Data
Devices and/or recovered data not collected within 60 days of customer notification will be considered abandoned and may be securely wiped or disposed of. DTR is not responsible for notifying the customer beyond the initial recovery completion notice.

Authorization and Payment
By submitting a device for data recovery, the customer authorizes DTR to attempt data retrieval and agrees to the estimated and final charges. Full payment is due before the release of any recovered data. No refunds will be provided for unsuccessful recovery attempts once the process has started.

Confidentiality
DTR treats all customer data as confidential. Recovered data is handled with strict data protection protocols and is not accessed, shared, or stored beyond the scope of service delivery.
